License
This license grants the Client (“Licensee”) an individual, non-transferable and non-exclusive right to use the photos provided. You may not share, sell, rent, lease, or sublicense the photos to any other companies or entities not mentioned in this license agreement.
Permitted and Prohibited Uses
The images may be used for the sole purpose of marketing the specific property photographed for the duration of the listing. The images may be used for any press articles, marketing, on-line use, as well as any form of reproduction, printed or digital, needed to market the property that has been photographed. The photos may also be used by the agent’s parent company for the sole purpose of marketing the specific property photographed for the duration of the listing, and must NOT be distributed to a third party without permission. The images may be backed up or archived as necessary to complete the above stated uses only. You may not resell, sub-license, give, lend, sub-let, distribute the whole or part of an image, whatever its size and resolution. You may not reproduce, resell or redistribute those images for commercial purposes or for marketing use with another selling agent or marketing company.
Copyright
All rights pertaining to the photographs are owned by David Reed and David Reed Iamges and are protected by United States Copyright Laws, international treaty provisions, and other applicable laws. No title, copyright, or intellectual property rights in the photos are transferred with this license. Full rights and copyright, including but not limited to self-promotion usage, remain with David Reed and David Reed Images — without exception.
Commercial
Commercial Rights are negotiated on a case-by-case basis. Customer is licensed to use products for a term of as little as one-year and as many as five-years.
Transfer
In short, no — you are not given Rights to transfer or extend your license to any other party.
If anyone asks you for any of your Rights to the Products, you agree to refer them to David Reed Images. If I agree to allow others to use the Products an additional licensing fee may be required from them. I agree not to use the Products in a way that interferes with your Rights.
Non-Compete
I will not license Products previously licensed to you to one of your competitors for use without first notifying you. Although the Products are mine to license as I see fit, I do not wish to interfere with your ability to operate or “ruffle any feathers” by doing so. (Translation: If another Realtor® takes a listing that you didn’t sell and wants to use the photos I took, I may sell them a license to use those images but will make sure you’re okay with it first. If you’re not okay with it I probably won’t.)
